 2006-10-27  CONVOCATION À UNE ASSEMBLÉE GÉNÉRALE EXTRAORDINAIRE ET MESSAGE AUX MEMBRES

FAISANT SUITE AU JUGEMENT DANS LA CAUSE ROULEAU-JONCAS

Pour vous permettre de comprendre la portée du jugement du juge Louis Crête, le MAC vous invite à une assemblée extraordinaire qui aura lieu mercredi le 13 décembre prochain à 19h00, au 3800 Bossuet (coin Sherbrooke).

Le 7 novembre dernier, le juge Louis Crête a rendu son jugement dans le recours collectif intenté par les requérants Michel Rouleau et Sylvie Joncas concernant les investissements dans les projets Etteloc (1992). Le juge a condamné la plupart des défendeurs à l’exception des procureurs généraux du Québec et du Canada. Notons que l’expert-comptable Normand Fortin se trouve parmi les défendeurs condamnés.

Le juge Crête a donc décidé qu’aucune faute n’avait été commise par les autorités fiscales. Il a par contre jugé que les demandeurs, par conséquent tous ceux qui ont investi dans les projets Etteloc, et les autres membres du groupe étaient responsables à 50% dans la cause civile... dont ils ont tous été victimes.

Monsieur Rouleau et Madame Joncas ont confié à leurs procureurs le mandat d'aller en appel car le jugement demeure silencieux sur une partie importante de la preuve; surtout la preuve qui a été faite pendant les trois mois d'audience, surtout la preuve concernant les fautes alléguées contre les autorités fiscales. Malgré que la cause ait été prise en délibéré pendant plus d’une année, les motifs du jugement ne sont pas étoffés et témoignent plutôt d’une vision réductrice de la preuve faite devant le juge. Trois juges de la Cour d’appel auront ainsi la lourde tâche de se pencher sur ce jugement très différent de ce que laissait entrevoir les rapports du Protecteur du Citoyen pour les investissements réalisés dans les années 1991 et 1992.

Etteloc Class Action: we are still waiting the ruling    

We are still waiting for the ruling of Justice Crête in the case of the Etteloc Class Action.  We will hold the next members 'general assembly in the days following the ruling.

In the mean time, the board of administration is conducting an online survey on our website for the awarding of a ''scandal'' and ''Oxygen'' prizes.  The Oxygen prize will be awarded to the person who has been most respectful of the taxpayers money.  The Scandal prize will go the the person who has been most ignorant of taxpayers money.

The prizes will be awarded in early September 2006.

It is with great regret that we have been informed of the death of one of our most active members as he was responsible for the  MAC in the Quebec Region for many years.

Mr. Jean-Louis Sénéchal died on February 3 after a long battle with sickness.

The Mouvement Action Contribuables will miss him.  We offer our sincere condolences to his family.

Important Changes in the Federal Equity Law

There are some important changes that will take effect in January 2005, regarding the Equity Law (Request for cancellation of Interests and penalties from January 2005)

For the years prior to 1994 , consequently, years that concern all investors in our groups, those who wish to ask for a cancellation of part or all of the interests charged on the assessments,  MUST DO SO BEFORE DECEMBER 31, 2004 !

We strongly urge you to write to the Chief of Appeals and demand a cancellation of all interests regarding your assessments for the years 1989-1993 included.

This demand may be done simply by writing to both Ministry of Revenue and registering your letter:

V.I.P. Message for Investors in the Group known as”ETTELOC” 92-93

 

 

During the hearing of the “ETTELOC”(or Gr.2)(Rouleau-Joncas) Class Action, a representative of Revenue Canada indicated that money was available to reimburse interests paid by investors on their assessments for those years.  Unfortunately, Revenue Canada refuses to systematically reimburse all investors in this group.  The investors MUST make a claim for the interests to be reimbursed to them.

You will find in the French part of this news, the extract from the hearing (in French) stating as much.

We strongly encourage you to proceed individually and rapidly in writing to the Federal Chief of Appeals (Revenue Canada) and demand a cancellation of the interests under the Federal "EQUITY LAW".

 2004-10-12  RDI Committee -Invitation to R&D Investors whose cases are before the Canadian Income Tax Court.

Information Meetings:

(This letter is addressed to people who are not included in the RDI Group (Investor’s group who are still in objection before the Canadian Income Tax Court))

Since Autumn 2003, many investors regrouped in order to argue their case before different courts; others have asked the court to postpone their hearing until 2005.

Us, Members of RDI Committee, had decided in 2003, to seek advice from the study of Marchand, Melançon & Forget (Barristers) in order to find out what our options were and what strategies to use, when pleading our case before the Canadian Income Tax Court.

Please note that this meeting is only to exchange ideas.  We would very much like to hear your views and ideas and how you perceive your own case before the court.

We have established an important strategy to intervene before the end of October 2004. Your comments and feedback are welcomed in any event.

We are inviting you to this meeting for the benefit of your individual case.  You will also have the opportunity to decide to join or not, our proposed request intended for October 2004.

Information sessions for R&D investors 1988-93

Five determined investors (Pierre-Paul Lafond, Christian Lavoie, Denis McNamara, Richard Mendes and Douglas Atherton) would like a final ruling for all the R&D cases presently before the Court.

In Octobre 2003, with the help of Mr. Normand Lassonde, they met with  Me Pierre Lessard to put in place an adequate group of R&D investors  and complete an working document toward a service contract with the lawyer. Since then, three information sessions have taken place and the group now counts a 150 investors.

 2003-10-10  MOTION PRESENTED BY MR. LASSONDE

Mr. Lassonde's Motion has been denied by the Canadian Tax Court.  Mr. Lassonde intends to appeal to the Canadian Federal Court within the next 10 days. The taxpayers who wish to do so, may link their cause to Mr. Lassonde's appeal by mentionning it to the Court when asked to respond in their own case.

 2003-09-07  Class Action Suit: KIMEX-GLOBEX

On September 5th , 2003, mister Vidal has served a motion to modify his class action suit to include as a defender, the accountants firm Harel-Drouin & Associates, as it was previously autorized by the Quebec Court of Appeal.

Mister Vidal has also served a motion to have the Court confirm that the members of the group called Kimex-Globex (represented by Mr. Meese)shall also be included in the Vidal Class Action.

Should the Court , by the voice of  Justice Diane Marcellin , authorize the motion, the members of the group Kimex-Globex (Mr Meese) will also be authorized to sue the the Governments and Harel Drouin & Associates.

Both motions will be heard at the set date by  Justice Diane Marcellin.

 

 03-08-19  The Case of Mr. Lassonde

The case of  Mr. Lassonde has been heard during the whole week of August 11 to 15 inclusively.  Now, we have to wait for the ruling from the presiding judge in the next few months.

In the meantime, we are working on our future  meeting with the minister of Revenue  in Qc.

 03-06-25  Special Motion Canadian Tax Court

The request will not be heard, as previously announced, on June 26-27. We have been informed that it will be heard sometime in early August. We will let you know the exact dates when confirmed.

 2003-04-23  Demonstration on April 12th 2003

 2003-04-23  Special Motion Canadian Tax Court

On April 17th of this year, Mr. Normand Lassonde, a Montreal Citizen, re-assessed for investments made in 1989 (SRET) has filed a motion to set aside assessments and interests due to excessive delays and oppression.  The motion will be heard by  the Canadian Tax Court.

Mr. Lassonde will argue that all assessments should be cancelled because they violate dispositions of the Canadian Charter of Rights and Freedom which condemns oppression and  promotes reasonnable delays.

Mr. Lassonde will support his arguments with numerous jurisprudences from the Supreme Court of Canada, 30 in all.

Mr. Lassonde has already been notified that his motion might be heard sometime in June of this year, at the Canadian Tax Court, in Montreal.  

We will inform you of the exact date as soon as it is confirmed to us.

 2003-03-10  DEATH OF ATTORNEY JEAN-MAURICE GAGNÉ

We just received word that the lawyer Jean-Maurice Gagné died on March 3rd after a couragous fight against cancer.

He was hospitalized at the Montreal Sacré-Coeur Hospital .

He was one of our greatest defender of the taxpayers who were trapped in the R&D projects.

He will be missed greatly !

If your answer is "no", that indicates that you do not wish to maintain your appeal and your file will be closed.   All amounts due in relation to this file, will become payable to the ministry of Revenue.

If « YES »

    You will be able to choose to proceed with your appeal under the tax law. If such is your choice, information on the Web site of the federal government will be very valuable to you.

 02-09-29  Canadian Tax Court

Additionnal informations for the taxpayers who received a summation to appear before the  Canadian Tax Court

There are two possible procedures:

1- The Informal Procedure:  This procedures is less demanding on all parties and can be compared to the small claims court in Quebec.  It can be chosen when the initial assesment is equal or under          12 000$ (excluding all interests that have been applied AFTER the initial assesment by the ministry of revenu).   You have the option of representing yourself or be accompanied by a lawyer or any professionnal deemed able to present the case such as a Fiscal Specialist.

2- The Formal Procedure:  This procedure becomes mandatory whenever the amounts assessed originally (excluding all subsequent interests being applied by the ministry of Revenue) is higher than       12 000,00$.  You may also reprensent yourself but if you choose to be reprensented by council you may only do so by a lawyer deemed able to practice in the country.

Last August 19, the taxpayers made their choice of winners known to the grand public.

The winner of the "Oxygen" award , for best help in reducing the taxes of taxpayers went to Mr. Claude Robinson.

The winner of the "Scandal " award went to Mr. Jean Chrétien, prime minister of Canada.

Both ministers of Revenue received a "Status Quo" award from the taxpayers, for not moving in the R & D case concerning some 10 000 taxpayers of Quebec.

Taxpayer Action Movement unveils the names of its  finalists

 

Montréal, July 23, 2002 – The public has made its voice heard, last month the Taxpayer Action Movement ( aka Mouvement Action Contribuables or MAC) asked the public to nominate their favourite candidates!  MAC invited all taxpayers to vote online at www.macquebec.org in order to complete the list of political figures, public personality, public or private organization most worthy  for nomination to the first “ Scandal of the Year Award”. Each year, the award is to be presented to the person or organization having been voted most proficient at squandering public funds (also known as taxpayer’s money). Given the abundant examples of such actions in the news, the public was not at a loss for nominees, nearly 5000 votes were cast. And the finalists are (in alphabetical order) Don Boudria, Jean Chrétien, Denis Coderre, Alfonso Gagliano, Guy Julien (Quebec‘s Minister of Revenue), Bernard Landry. These then are this year’s finalists for this fleecing of  the public award and need we say …for this far from prestigious prize.

While at it, the MAC  also polled the public in order to learn of the good deeds of those who  may have devoted their efforts to improving the desultory lot of the  taxpayers.

 

THE FINALIST OF THE 2002 OXYGEN AWARD

 Oxygen! Give us some breathing room! We requested names in our search for candidates for the 2002 Oxygen Award (note that the title ¾ Oxygen/Oxygène ¾ has no link to a certain Quebec lobbying firm with which we might be oh so tempted to associate it …). We asked for the names of the good guys, those who  helped out taxpayers breathe better…through their actions , names of people that are above all suspicion!  Well, there were fewer suggestions, but quality finalists nonetheless. The finalists are: Claude Béland (who turned in his resignation as President of Quebec’s largest new hospital CHUM project ) after exposing numerous questionable contracts. Mario Dumont (for standing up for changes at Quebec’s National Assembly, and requesting tougher conflict of interest regulations). Joseph Facal (for having had the courage to speak out about the plight of the average Québecer). André Pratte (for his role as a leading editorialist at Montreal’s La Presse newspaper. He has denounced in no uncertain terms the many cases of abuses and of squandered funds. Claude Robinson, a children animation producer, who was instrumental in unearthing the Cinar scandal (involving large federal government funds earmarked for Canadian talent).

As stated by MAC President Hélène Labrèche, “These symbolic awards are only one aspect of the public demonstrations that MAC organizes with the aim of increasing the population’s awareness of our cause. With this contest, we want to emphasize that the time has come to put an end to these disgraceful scandals and make room for a wave of fresh, clean air. Québecers, the most heavily burdened of Canadian taxpayers, have the right to breathe!”

The awards ceremony, hosted by MAC President Ms. Hélène Labrèche and Professor Léo-Paul Lauzon, Chair of socioeconomic studies at UQAM, will be held at the Centre Saint-Pierre in August of this year.Finalists will be asked to attend.

 01-08-01  Letter sent by the Canadian Tax Court

The members of the group "Me Jean-Maurice Gagné" who decided to appeal their objection case, following the jugment rendered in the case of   R. Mckeown  in the spring 2001, are now receiving a letter from the Canadian Tax Court.

This letter means in essence, that since Me Gagné did not wish to continu representing the said members and  as such, was abandoning the case, you will now be considered your own lawyer.

You will now receive all pertaining documentation , unless you hire a new lawyer on your case, in the future.

Our meeting with the Minister of Revenue Qc and the sub-minister of Revenue went very well. We all agree, it seemed like they were really interested in our version of the facts. We did not come back with a promise from the Minister but he did say "that he did not meet us for nothing". We will keep you informed of the developments.

Victory !  Etteloc, groups of 5 !

The Quebec Court of Appeal has rendered judgment in the "Etteloc" Class Action.  The Governments did not want to give access to certain informations concerning the investments made by taxpayers in the case of Etteloc (Societies of 5). 

The Quebec Court of Appeal has refused the Governments' objections and permitted access to all pertinent informations.  The jugment will be on our site in the "Court Cases" section.

We will see if the Governments will appeal this ruling to the Supreme Court of Canada.

We have received a written confirmation that the Minister of Revenue Quebec will meet with us.

We will prepare the agenda for this future meeting and let you know how and when , it will take place.

Message from Sylvain Castonguay:
Following the judgment rendered recently in the McKeown's case , the federal agency finally decided to start moving our files forward. On July 24th 2001 , in the Tax Court of Montreal, we will plead a motion aiming at :
  • striking the vast majority of documents that Justice Canada wants to incorporate in our debate before the Court ;
  • getting the Court to narrow down the debate to the only question we feel it should be dealing with, namely the level of participation requested from each of the partners in the Vohoang partnerships 89-90 (the first ones selected to go to trial) , thus establishing a clear cut distinction with the legal situation reflected in the McKeown situation.
Revenue Canada wants ,once more , in our cases to litterally swamp the Court with all kinds of arguments that have no relation and no legal basis with the notices of assessment that are being appealed in front of the said Court. The Canadian tax law doesn't allow Revenue Canada to (again) change its mind some eleven years after the initial notices of assessment have been issued and this is what we will demonstrate in the July 24th motion 's presentation.
As soon as we will be in receipt of the judgment on our motion, we will initiate a general mailing to all our partners to bring everybody up to speed in these files and to suggest also an efficient mode of conduct for the steps ahead. We feel sorry for not having brought to you some news earlier than now , but in reality, nothing has been moving in these files for the last 2 and a half years.

 01/06/09    CLASS ACTION: KIMEX/GLOBEX (A.MEESE) 

The appellant in the case has decided to appeal the jugment of the Québec Cour of Appeal to the Supreme Court of Canada. All will depend on the approval of finnancial aid from the "Founds for Class Actions". We will keep you up to date on the case.

 01/05/21    CLASS ACTION: KIMEX/GLOBEX (A.MEESE) 

the Quebec Court of Appeal has rendered judgment in the case of Kimex/Globex. The Court of Appeal has confirmed the judgment of the Superior Court Judge Dalphond. We are in agreement that the Court of Appeal has erred in its appreciation of the requirements giving authorisation to a class action. Moreover, in its judgment, the Court of Appeal confirms the conclusions of the Superior Court which ,we humbly and respectfully submit, concludes unjustly on the character of the representative and by inference, to the whole group, without hearing full testimony of the representative on his own behalf. We are also in agreement, that the Superior Court contredicts itself when compared to a previous judgment rendered in the case of Rouleau/Joncas (Etteloc). We think this judgment should be appealed. We will morally support , any decision that the representative shall take in this case.

We have been informed by the representative of the group "Fonds de défense" that Mr.R.Mckeown will not appeal the ruling rendered by the Tax Court of Canada in the case of R.Mckeown vs The Queen. The members of the group will receive a letter from their lawyer explaining their options and consequences resulting from the recent ruling.

We have also been informed that the members of the group with Me Castonguay will also be receiving a letter informing them of his analysis of the situation.

If you choose to abandon your objection You will receive a letter confirming your decision Your account will but brought to date and definetely closed and the final amount due will be billed to you. You should then contact the agent assigned to you account and try to make an arrangement that you can live with.

POSITION OF THE ASSOCIATION ACAPDP-R&D
  • Considering that the Association has a mandate to defend all the different groups who invested in these R&D cases,
  • the Board of Administration is and always was in complete disagreement with the position taken by the different ministries in the said R&D cases and the adding of interests the the amounts claimed only serves to reinforce our position.
Consequently, the members of the Board of Administration recommend that the investors of The Groups of 5 (Etteloc and others) proceed individually in writing to the Federal Chief of Appeals and demand a cancellation of the interests under the Federal "EQUITY LAW" inspiring yourself with the following guidelines if applicable as cited in the Governements documents: " When a taxpayer is unable to conclude a reasonable payment arrangement because the interest charges absorb a significant portion of the payments. In such a case, consideration may be given to waiving interest in all or in part for the period from when payments commence until the amounts owing are paid provided the agreed payments are made on time.»

 00/06/15    GROUPS OF 5 , ETTELOC ,1992-93 : letter from the federal governement 

Investors in the groups of five called ETTELOC (or Double-Edge or Roy brothers) 92-93 are presently receiving la letter from Canada Customs and Revenue Agency (Revenue Canada). This letter is directly linked to the OBJECTIONS filed following the notices of assessment sent by both governments in 93 and 94. The OBJECTIONS were appealed and the Québec Income Tax Court ruled in favor of the Québec Government in October 1999. The plaintiffs did not appeal this ruling in the said Québec Court. In Québec, most investors had not received the claimed credits so there is no financial consequences in Québec. Not so in the case of the Federal Government as most of these credits were paid to the investors and many taxpayers waited for the ruling to pay the amounts claimed.

The Federal Governement is now sending a letter asking investors if they wish to pursue their OBJECTIONS in the Federal Tax Court or not. The Association has asked for a legal advice in this matter. We will inform our members of the different options that are available to them in time for the July 10 deadline.
Please take note that this has nothing to do with the CLASS ACTION of Etteloc in the Superior Court of Québec. We are dealing with two (2) different laws. This is a taxation matter only and the CLASS ACTION is a civil matter.

 00-05-10    GROUPS OF 5 , ETTELOC AND NON ETTELOC: 1992  

On Thursday May 4, the Association met with 3 representatives from the Canada Customs and Revenue Agency (Revenue Canada).

We stressed the fact that the members of that group are worried since they have not heard any news from the federal government following the jugement rendered in the case of Fortin vs Revenue Quebec in October 1999.
We were then informed that the taxpayers should expect a letter stating the position of the federal government later on this month of early June.
We where also informed that the taxpayers should expect the full application of the law concerning interests charges on unpaid balances. If any measures are to be applied to ease the amounts they will have to be taken on an individual basis.
We will keep you posted on measures that can be applied as soon as we can.

 00-04-07    CLASS ACTION: FORGUES BROTHERS 

The Quebec Superior Court has authorized another class action in the research and development projects between 1989-1993.

The FORGUES brothers have been authorized to represent the investors (around 1200) in a civil class action lawsuit for damages against promoters, vendors, resellers etc…and against both the federal and provincial governments (Quebec).
The code of civil procedure does not allow for an appeal in this case.

 00-02-10    CLASS ACTION: KIMEX-GLOBEX 

Mr.Meese has appealed the ruling authorizing in part, the class action in the case of Kimex-Globex. Indeed, the judge has excluded from the class action, the governements, an accountant firm and a law firm. The Quebec Court of Appeal will have to hear this case before the class action can begin.

 00-01-28    KIMEX-GLOBEX 

The Association of taxpayers who invested in projects of R&D has called a Press Conference on TUESDAY FEBRUARY 8, AT 10:00 A.M. The press conference will be held at: CENTRE SAINT-PIERRE : 1212 RUE PANET, MONTREAL (QC)ROOM 201. Members are welcome to attend. We will bring the journalists up to date on the different court actions and Mr. André Meese will be announcing his decision concerning the recent ruling in the case of KIMEX-GLOBEX class action.

 00-01-04      Groups of 5, NOT included in Etteloc 

Investors involved in groups of 5 NOT included in the project Etteloc (around 300 persons) should start receiving letters from the minister of finance. This letter is informing them that the Québec Income Tax Court has ruled in favor of the government in the case of Etteloc following their OBJECTION for tax credits refused in 1992. The letters are signed by Me Brazini, who is responsible for this project. The letter is considered a first step response to the OBJECTIONS delivered to the Chief of Appeals in 1994. (Administrative response) This group of investors has 90 days to appeal this administrative ruling, which in doing so will take them to the next step, the judiciary one. (A judge will hear the objection) At this stage, we strongly recommend you get a professional advice on whether to proceed or not. Investors, who feel that their group of 5 was very DIFFERENT than those in ETTELOC, should do so. You may contact the firm Renaud/Brodeur who handled the case of Etteloc, as they have a good knowledge of the situation before deciding. But we do not have any agreement with the firm and one is totally free to choose any lawyer to get this advice.

 99-12-30    CLASS ACTION : KIMEX/GLOBEX 

The Court has allowed the plaintiff, Mr.André Meese,to institute a class action against vendors and promotors but not against the professionals involved and the governments.
Mr. André Meese has 30 days to appeal, which we hope he will. With all due respect for the honorable justice Dalphond, the judgement should be appealed. It contains,in our humble opinion, errors in law and has many contradictions.
WHAT SHOULD YOU EXPECT ?
  • Mr. Meese has until Jan 15, 2000 to decide for an appeal
  • If he does, that should take a year at least for the Court of Appeal to rule.
  • Then, the case goes back to the Superior Court to begin.
We suggest you keep all papers relating to your investments in a safe place for when the time comes, you will need them to claim your share of money if the case is won by the the investors in R&D.

 99-11-25    RULING IN THE INCOME TAX COURT OF QUEBEC 

The income tax court of Quebec has ruled that the investors in the groups of 5 called "ETTELOC" or "DOUBLE EDGE" or FRERES ROY are not allowed the income tax credits claimed during the year 1992-93. We want to remind the members that this ruling has no incidence on the CLASS ACTION, which is presently before the Superior Court.
We also want to inform the members that Renaud/Brodeurs, the lawyers representing the investors are suggesting that appealing the ruling would be a waste of money for the r&d investors. But if some investors feel that their case is different than the 3 that were chosen to be heard by the court, they may file their own defence. Renaud/Brodeur will analyse your case and tell you if you do have a case. If, not, the lawyers will close your file for 15,00$ which we feel , is quite reasonable.
WE MUST INFORM you that, you may expect to receive a notice of assessment from Quebec, if you owned money in 1992 Etteloc,if there is no appeal. Also, we have been informed that, the Federal Government is expected to send some kind of notice giving you the opportunity to file an appeal in the federal court or 30 days to explain your case. If not, one must expect to receive a notice to pay the amount owned.

 99-08-24    GST RETURNS IN THE GROUPS OF 5-ETTELOC 1992 

We have had confirmation today from the person in charge of these cases in the Government that returning the money to those who had paid the GST in these groups of 5 will be on the agenda in the next month. We were told that it is not as simple as one may think. Each case must be reviewed properly in order to trace the amounts paid and to retrace the taxpayer who got the bill in the first place. Also, they must find out if others in each concerned groups had repaid their part to the person in each group who has received the first bill etc... We were also told that only a small minority of taxpayers had paid the GST. It does seem, once again, that patience must prevail.
